1. Scope
These General Terms and Conditions (GTC) apply to all deliveries by BUYOND GmbH (hereinafter: BUYOND).

3. Offer and Conclusion of Contract
3.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. Errors excepted.
3.2 By clicking the "Submit Order" button, you place a binding order for the products listed on the order page. The purchase contract is concluded upon delivery of the ordered goods.
4. Prices and Shipping Costs
4.1 The prices stated on the product pages include the statutory value-added tax and other price components.
4.2 Unless otherwise indicated, the shipping costs within Germany are €3.95 including 19% VAT per order. The shipping costs will be clearly communicated to you on the product pages, in the shopping cart system, and on the order page.
5. Delivery
5.1 Delivery is only made within Germany via DHL.
5.2 The delivery time is 1-3 working days. Any deviating delivery times will be indicated on the respective product page.
6. Payment
6.1 Payment is made by prepayment, direct debit, cash on-site, PayPal, or on invoice for companies, as chosen.
6.2 If you choose the prepayment payment method, we will provide you with our bank details in the order confirmation, and we will deliver the goods after receipt of payment.
6.3 Payment by direct debit
If you grant us a SEPA mandate, payment will be made by debiting your bank account. The account will be debited after the goods have been shipped. We will inform you separately in advance about the date of debiting. The pre-notification period for debiting (pre-notification period) is shortened to 3 days.
6.4 You are only entitled to offsetting if your counterclaims have been legally established, are undisputed, or have been acknowledged in writing by us.
6.5 You can only exercise a right of retention to the extent that your claims arise from the same contractual relationship.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Warranty
The warranty is provided in accordance with legal regulations. In the case of defects that occur within the statutory warranty period of two years from delivery, you have the statutory right to subsequent performance (your choice: rectification of defects or delivery of new goods) and, if the statutory requirements are met, the statutory rights to reduction or withdrawal as well as damages.
9. Final Provisions
9.1. Oral collateral agreements do not exist. Changes and additions to these General Terms and Conditions require text form. This also applies to the abolition of this text form clause. If written form is legally required, it can only be replaced by electronic form within the meaning of § 126a BGB or by notarial certification in accordance with § 126 (4) BGB. If parts of these General Terms and Conditions are or become invalid, this does not affect the validity of the remaining provisions. The ineffective provision shall be replaced by an effective one that comes as close as possible to achieving the desired economic purpose, taking into account the interests of the parties. The same applies to filling gaps that may arise. For all legal relationships between BUYOND and the customer, the law of the Federal Republic of Germany, which is applicable to legal relationships between domestic parties, shall exclusively apply.
